The Seller specializes in offering gold and silver investment products and services for consumers, which are marketed through our website: https://gold-union.com. You can find a detailed list and description of our products and services on this site.We present and explain our company’s activities and the intended use of our products, in compliance federal rules and regulations.

Article 1: Purpose

These General Conditions of Sale outline the rights and obligations of both parties concerning the online sale of products offered by the Seller. This document details the purpose of the contract, which is the online sale of products by the Seller.

Article 2: General provisions

These General Conditions of Sale (CGV) apply to all sales of products made through the Company’s website and are an integral part of the contract between the Buyer and the Seller.The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The Terms and Conditions in effect at the time of payment (or the first payment in the case of multiple payments) will apply to the order.You can review these General Terms and Conditions on the Company’s website at goldunion.fr. The Company ensures that acceptance of these terms is clear and unreserved by implementing a checkbox for validation.By checking the box, the Customer confirms they have read and accepted these General Conditions of Sale, including any Special Conditions related to specific products or services, without restriction or reservation.The Customer acknowledges they have received the necessary advice and information to determine the suitability of the offer for their needs. Additionally, the Customer declares they are legally able to enter into a contract under governing laws of the United States of America and the State of California by default, or any other local State as may be required by law or are validly representing a natural or legal person for whom they are contracting.Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

Severability : If any provision of this Agreement is deemed unlawful or unenforceable, that provision will be considered null and void. However, the remaining provisions of this Agreement will remain in full force and effect.

Article 3: Pricing and taxes

 

All product prices on our website are listed in Dollars ($) and are shown excluding taxes on the product description pages. On the order page, the prices are displayed excluding all applicable sales taxes and shipping fees.For orders shipped outside the United States of America prices are calculated without taxes on the invoice. Please note that customs duties, local taxes, import duties, or other state taxes may apply depending on the destination. These additional costs are not the responsibility of GoldUnion and must be handled by the buyer, including making declarations and payments to the relevant authorities. We advise customers to check with local authorities for more details regarding these possible charges.

Price Modifications

GoldUnion reserves the right to adjust product prices at any time, but any changes will apply to future orders only. The price displayed at the time of purchase will remain valid for that order. Please note that the cost of accessing our website, including any necessary telecommunication fees, is the responsibility of the customer. Delivery fees, if applicable, will be clearly stated at the time of purchase.

Article 4: Conclusion of the online contract

To complete an order, the Customer must follow a specific set of steps for each Product offered by the Seller.

These steps are as follows:

Review the essential characteristics of the Product.

Choose the Product, including any options, and provide necessary Customer information (identification, delivery address, etc.).

Agree to the General Conditions of Sale by checking a box.

Verify the details of the order and correct any errors if needed.

Follow the payment instructions and proceed with the payment.

Products will be delivered to the address provided by the Customer.

Once the order is placed, the Customer will receive an email confirmation with payment details and an acknowledgment of the order.

A PDF copy of these General Conditions of Sale will be provided.

For product deliveries, the Customer must ensure that the provided identification and delivery details are accurate. The Seller reserves the right to refuse any order if there is an abnormal request, bad faith, or any other legitimate reason.

Article 5: Products and services

The essential characteristics of the products and services, including their respective prices, are clearly detailed on the Company’s websites. The Customer confirms having received all necessary information, including delivery costs, payment terms, and contract execution details.The Seller commits to fulfilling the Customer’s order based on available stock. In the event of unavailability, the Seller will inform the Customer. All contractual information is provided in English, and in compliance with the governing laws of the United States of America and the State of California by default, or any other local State as may be required by law, this information is summarized and confirmed upon order validation.

Illustrations or photos of products displayed on the websites are for reference only and hold no contractual value.

Offer Validity

The validity period of product offers, their prices, and the minimum contract duration (if applicable) are specified on the Company’s websites. Unless otherwise stated, rights granted under these terms apply solely to the person placing the order or the email account holder.

Product Return and Refund

In accordance with legal provisions regarding product conformity and hidden defects, the Seller will refund or exchange defective products or products that do not match the order. Refunds can be requested via email at goldunionpro@gold-union.com, and are processed after the returned goods are received, including shipping costs.

Minors and Precious Metals

Minors are not permitted to purchase gold or silver in their own name. However, parents or legal guardians can buy precious metals for their children as a form of investment or gift. Upon reaching adulthood, the sub-account holder gains full ownership of the ordered precious metals.

Article 6: Reservation of title clause

The products remain the property of the Company until full payment is received. Ownership is transferred to the buyer only after the total price has been paid. Until then, the products legally belong to the Company, even if delivered to the buyer.

Article 7: Delivery terms

Products will be delivered to the address provided during ordering, within the indicated delivery time. This time frame does not include the order preparation period. If delivery requires an appointment, the customer will receive an email to select a time slot. If multiple products are ordered, they may be delivered at different times. In the event of a delay, the customer can terminate the contract according to the terms and conditions of sale.  

The Seller will then refund the product and the initial delivery costs.Delivery times typically range from 5 to 10 working days. If there is a delay, customers will be notified through their online account or by phone. The order preparation begins once the customer's identity document is received via their online account or by email at goldunionpro@gold-union.com.A customer service contact number is provided in the order confirmation email for tracking purposes. Risk of loss or damage transfers to the customer when they physically receive the product. The customer must notify the carrier of any issues with the delivered product.

Article 8: Availability and presentation

Orders will be processed based on available stock. If an item is unavailable for more than 4 working days, the customer will be notified immediately, and they may cancel the order. The customer can choose to receive a credit or a refund for the unavailable item.

Article 9: Payment

Payment is due upon ordering, even for pre-ordered products. Customers can pay by credit card, wire, echeck or bank check. Cards issued by banks outside of the United States must be international (Mastercard or Visa). Secure online payment is processed through our payment provider, and all transmitted information is encrypted for safety. Once payment is initiated, the transaction is immediately processed. As per the Monetary and Financial Code, payment by card is irrevocable. By providing card information, the customer authorizes the Seller to debit the corresponding amount. In case of an error or inability to process the payment, the sale will be canceled. For lost checks, a fee of $15 will be deducted for bank charges related to stopping the check. If the amount of the check is $16 or less, the check will not be reissued.

Article 10: Can I Cancel My Order?

Due to the fluctuating nature of gold and silver prices in financial markets, you cannot cancel or withdraw from your order once it's been placed. This also applies to gold and silver purchases. Article 11: What Are the Guarantees on My Purchase?

You are protected by two main guarantees : We will replace or refund products that are defective or do not match your order.

Return Policy: You have 7 days from delivery to claim if there are hidden defects and to return a product.To request a refund or exchange, contact us at goldunionpro@gold-union.com. We’ll guide you through the process.

Article 12: How Can I Make a Complaint?

Article 13: Who Owns the Intellectual Property Rights?

All intellectual property (brands, images, videos, software, etc.) remains the sole property of the Seller. Reproduction, modification, or use without permission is strictly prohibited.

Article 14: What Happens in Case of Force Majeure? 

If unforeseen events or force majeure prevent us from fulfilling our obligations, we will notify you as soon as possible, and our responsibilities will be temporarily suspended until the situation is resolved.

CLASSIC STANDARD CLAUSE

Article 15: What If Part of My Contract is Invalid?

If any part of this contract is found to be invalid, the rest of the contract will still remain in effect. Any changes to the contract are only valid when both parties agree in writing.

We respect your privacy. You have the right to access, modify, oppose, and correct your personal data. By accepting these terms, you agree to our collection and use of your data to fulfill this contract.

Article 17: What Law Applies to My Purchase?

These terms and any transactions made are governed by United States laws.

Article 18: Do I Need to Provide an ID? 

Yes, purchasing precious metals requires a valid ID (identity card, passport, driver’s license, or residence permit). If ordering in-person, please provide a copy of your ID when placing your order. 

For online orders, email your ID to goldunionpro@gold-union.com. Your order will be shipped only after we receive your ID.

We retain this information for five years, as required by tax regulations for transactions involving gold and silver investments.
